According to the new regulations issued by the U.S. Federal Communications Commission (FCC) on August 7, 2025: ET Docket No. 24-136; FCC Docket No. 25-27; FR Doc. No. 305703, the FCC requires all recognized TCB certification bodies, FCC test laboratories, and laboratory accreditation bodies to submit two documents by October 6, 2025, proving their organization is not held, controlled, or directed by any prohibited entity (§2.902).

 All recognized TCB certification bodies, FCC test laboratories, and laboratory accreditation bodies are required to submit the following documents by October 6, 2025, to prove that their organization is not held, controlled, or directed by any prohibited entity (§2.902):

 Submit the documents by December 5, 2025, and clearly list any entity that holds more than 5% of your organization's equity or voting rights.   

   The FCC also revised its regulations: 

For any TCB institution, testing laboratory, or accreditation body that fails to provide the above two pieces of information in a timely manner or provides false or inaccurate information, the FCC will revoke their existing accreditation.   

For new TCB institutions, laboratories, or laboratory accreditation bodies recognized by FCC for recognition, FCC also increases the requirement to submit the above two documents (Ref. § 2.951). 

FCC will not recognize any TCB institution, testing laboratory, or laboratory accreditation body owned, controlled, or significantly influenced by a prohibited entity (§2.902), and such TCB institutions, testing laboratories, and laboratory accreditation bodies are prohibited from participating in the FCC equipment authorization program.  

These requirements apply not only to testing laboratories executing FCC equipment certification procedures but also to laboratories conducting tests for suppliers' Declaration of Conformity (SDoC) programs.  

These new regulations take effect on September 8, 2025. FCC explicitly states that these new rules are applied equally to all TCB institutions, testing laboratories, and laboratory accreditation bodies, regardless of whether there is a Multilateral Recognition Arrangement (MRA), or where their organizational location is situated. 

For FCC-recognized testing laboratories, the above declarations can be submitted through the corresponding body responsible for accrediting such laboratories, e.g., A2LA, ANAB, NVLAP, EUDE01, Japanese MIC, RRA, NCC, BEISTF.
